Estee Lauder sues over copycat perfumes

Estee Lauder Cos., the maker of Clinique and Bobbi Brown cosmetics, accused CVS Caremark Corp. and Family Dollar Stores of selling knockoff fragrances in a trademark-infringement lawsuit. Woonsocket-based CVS and Family Dollar, which sells goods for less than $1, stock “copycat” perfume made by Preferred Fragrance Inc., according to a complaint filed in federal court in New York. Preferred Fragrance, based in Brooklyn, was also sued. The alleged copies are sold under names that are confusingly similar to Estee Lauder's trademarked “Beautiful” and “Pleasures” lines of fragrances, according to the suit. The mark for Estee Lauder's “Happy” fragrance by Clinique is also being violated, the New York-based company said. “The goodwill that plaintiffs have built up in their brands through years of substantial investment and effort is put at risk by virtue of defendants' commercial misappropriation,” Estee Lauder claimed in court papers. The disputed products are sold under the names “Impression of Beautiful by Estee Lauder” and “Impression of Pleasures by Estee Lauder,” according to the suit. Estee Lauder's “Beautiful” and “Pleasures” lines of perfume generated U.S. sales of more than $700 million during the past five years, the company said. The company is seeking $1 million in damages for each category of counterfeit trademarks and products. Michael DeAngelis, a spokesman for CVS, declined to comment. Kiley Rawlins, of Charlotte, North Carolina-based Family Dollar, didn't immediately return a call for comment.
